OBJECTIVES & FUNCTIONS

  1. Sindh Seed Corporation was established through an Act passed by the Sindh Assembly in the year 1976. Its main objectives are as follows:
  • To streamline seed multiplication system for production of Basic Seed. Procurement and distribution of certified seed.
  • To produce basic seed for further multiplication at registered grower’s farms, supply to private seed companies as per provision of Seed Act, 1976.
  • To produce certified seed for distribution to growers of Sindh at affordable rates.
  • To procure and process seed for marketing & distribution in Sindh Province.

Karachi, the 4th March 1976

 

No PAS/Legis/Bill-5/76, the Sindh Seed Corporation Bill, 1976 having been passed by the Provincial Assembly of Sindh on the 24th February, 1976 and assented to by the Governor of Sindh on 2nd March 1976 is hereby published as an Act of the Legislature of Sindh.

(First published after having received the assent of the Governor of Sindh in the Gazette of Sindh (Extra-Ordinary) dated 4th March, 1976.

AN ACT

to provide for the establishment of a Corporation for production, procurement, processing, marketing and distribution of seed for the province of Sindh.

WHEREAS it is expedient to provide for the establishment of a Corporation for production, preamble, procurement, processing, marketing and distribution of seed for the province of Sindh;

It is hereby enacted as follows:-

CHAPTER-I
PRELIMINARY

Short title and Commencement. 1.

  • This Act may be called the Sindh Seed Corporation Act, 1976.
  • It shall come into force on such day as Government may, by notification, appoint.
  • Government may, by notification, exempt any area of any kind of seed from operation of all or any of the provisions of this Act. 

DEFINITIONS 2.  In this Act, unless there is anything repugnant in the subject or context.

  1. "Corporation" means the Sindh Seed Corporation Established under Section 3;
  2. "Government" means' the Government of Sindh;
  3. "Managing Director" means the Managing Director of Corporation and includes any person discharging the duties' of the Managing Director for the time being;
  4. "Member" means the member of the Corporation and includes its Chairman; and
  5. "Prescribed" means prescribed by rules or regulations made under this Act.

CHAPTER-II

CONSTITUTION OF THE CORPORATION.

Establishment of the Corporation, 3.

  • There shall be established a corporation to be called the Sindh Seed Corporation for carrying out the purposes of this Act.
  • The Corporation shall be a body corporate, having perpetual succession and common seal with power, subject to the provisions of the Act, to acquire and hold property, both movable and immovable and may by the said name, use or be used.
  • The Head Quarters of the Corporation shall be at Karachi or such other place as Government may fix by notification.

Constitution of the Corporation 4.

  • The Corporation shall consist of such number of official and non-official members, as Government may appoint; provided that adequate representation shall be given to farming and seed trading
  • One of the members may be nominate by Government as Chairman of the Corporation.
  • The Managing Director shall be the Secretary of the Corporation.
  • An Official member appointed by virtue of his office shall cease to be member on vacating such office.
  • A non official member shall hold office for a period of three years unless he resigns by addressing a letter to Government or removed earlier, for reasons to be recorded in writing, by Government.
  • A member appointed in the casual vacancy shall hold office for the un-expired portion of the term.

Fees allowances to non-official members. 5.

Government may allow such remuneration, fees, allowances or other privileges to non-official members as it may determine.

Executive authority 6.

The executive authority of the Corporation shall vest in the Chairman or, in his absence, in a person nominated by Government. 

Managing Director 7.

  • Government shall appoint a person as Managing Director possessing
    such qualifications and on such terms and conditions as may be
  • The Managing Director shall, be whole time officer of the Corporation
    and, exercise such powers and perform such duties as may be assigned to him.
  • Government may remove the Managing Director if he;
  • refuses or fails to discharge or becomes incapable of discharging
    his responsibilities under this Act;
  • has, abused his position as Managing Director; or
  • has directly or indirectly acquired or attempted to acquire without permission in writing of Government any share or interest in any properry, scheme project or other concern of the Corporation.
  • The Managing Director shall be liable to such disciplinary action and in such manner as may be prescribed. 

Appointment of Officers Advisers and other staff of the Corporation 8.

  • The Corporation may for efficient performance of its functions appoint such Advisers, Officer including Director. Deputy Director, Additional Directors, Assistant Directors and other staff possessing such professional, technical ministerial or secretarial qualification and experience and on such terms and conditions as may be
  • The officers employees and staff of the Corporation shall be liable to such disciplinary action and in such manner as may be prescribed.

Financial Technical and Advisory Committee 9.

The Corporation may in such manner as may be prescribed, constitute such financial, technical and advisory Committees, as may be deemed necessary, for carrying out the purposes of this Act.

Delegation of Powers.1 ( ).

  • The Corporation may, by general of special order and subject to such conditions as it may impose, delegate to the Chairman, Managing Director, Member, or its Officer or employee, any of its powers, or functions under this Act or the rules and regulations made there under:-
  • The Chairman or Managing Director may delegate to any Officer or employee of the Corporation any of his powers under this Act or the rules or regulations made there under not being power delegated to him under sub-section (1).

Meetings of the. Corporation.11.

  • The meetings of the Corporation shall be held at such time and place as may be prescribed.
  • The meetings of the Corporation shall be presided over by the Chairman and in his absence by. such member as may be nominated by him and failing such nomination by such member. as may be chosen by the members present at such meeting:
  • One-third of the total members shall form a quorum for a meeting of the Corporation.
  • Any matter required to be decided by the Corporation shall be decided
    in a meeting of the Corporation by vote of majority of members present is such meeting.
  • Each member shall have one vote and in the case of tie, the Chairman shall exercise a casting vote.
  • No act or proceeding of the Corporation shall be invalid merely by reason of any vacancy in, or any defect in the Constitution of the Corporation.

Powers to Asssociate. 12.

The Corporation may, for carrying out any purpose of this Act, associate with a person or body of persons whose assistance or advice it desires to avail of, on such terms and for such period as it may deem fit.

Government to give directions 13.

  • Government may require the Corporation to furnish to it any document, return, statement estimate statistics, or any other information regarding any matter under the control of the Corporation.
  • Government may, from time to time, give such directions as it considers necessary for the guidance of the Corporation.

 

CHAPTER III

POWER AND FUNCTIONS OF THE CORPORATION

Powers and Functions of the Corporation .14.

The Corporation may-

  1. take such measures as may be necessary for marketing and distribution of Seed.
  2. Prepare and implement a plan for setting up seed industry in the province and take all such measures as may be necessary for promotion of such industry,
  3. Provide or causes to be provided information, advice and consultancy services relating to seed industry and matters connected therewith;
  4. Carry out or cause to be carried out experience in the field of seed propagation and multiplication;
  5. Procure requisite personnel, funds and equipment and mobilize other resources in and outside the province for achieving goals set by it;
  6. Provide or cause to be provided facilities for professional training in production, procurement, Processing, marketing and distribution of seed and related fields within and outside the province;
  7. Corporate with Government, non-Government and international agencies in all such activities which may load to the attainment of the objectives of the Corporation;
  8. Procure, produce, import or multiply such species of seed as may be notified by Government.
  9. Arrange for multiplication, procurement, processing bagging and storage of certified seed; Under-take or cause to be undertaken marketing of certified seed through public and private sector.
  10. Arrange for expert of the certified seed in excess of domestic requirements;
  11. Take over and manage seed farms on such terms and conditions as may be deemed fit.
  12. Make suitable arrangements for the multiplication of seeds on private farms under its supervision.
  13. Make suitable arrangements for the certification of seed in such manner may be prescribed.
  14. Render technical advice and other winces to the registered growers.
  15. Contribute towards the cost of any studies, services, experiment or technical research connected with the other person agency or body.
  16. Enter into cooperation with seed Corporations in other Provinces.
  17. Receive advice from the Provincial and national Seed Councils and render advice to such Councils.
  18. Arrange for adopting and propagating prescribed seed standards.
  19. Give aid for developing pure seed production farms.

Powers of Corporation 15.

  1. to acquire property, movable or immovable,
  2. to dispose off any property vested in it,
  3. to incur expenditure or carrying out purposes of the Corporation.
  4. to procure necessary equipment for its proper functioning.
  5. to enter into and perform contracts,
  6. to establish field offices, centres and institutions.
  7. to require any grower to furnish any information, record, report or plan or other material relating to any matter under this Act.
  8. To make inspections of seed farms.
  9. To take such action as may be necessary or conducive to the attainment of the objectives of the Corporation.

 

CHAPTER IV

FINANCE, AUDIT AND ACCOUNTS;

Audit and Accounts 16.

  • There shall be a separate fund of the Corporation known as the Sindh Seed Corporation Fund.
  • The fund shall consist of:-
  •   Grants and subsidy received from Government;
  •    Loans raised or obtained by the Corporation;
  •    Sale proceeds, fees, commissions and other charges for services rendered under the       Act.
  •    All other sums receivable by the Corporation; and
  •    Donations
  • The amounts credited in the Fund shall be deposited in a Bank approved by the Corporation.
  • The Corporation may invest its funds in any security of Federal Government or Provincial Government or any other security approved by the Corporation.

Powers of the Corporation to borrow money. 17.

The Corporation shall, subject to any general or special of Government, have power to obtain loan from banks or other sources and for this purpose it shall be deemed to be a local authority under the Local Authorities Act, 1914 (Act IX of 1914), provided that no foreign loan shall be obtained without the prior approval by the Government.

BUDGET.18

The annual Budget of the Corporation shall be prepared and approved in such manner as may be prescribed.

Accounts and Audit 19.

  • The Corporation shall maintain or cause to be maintained its accounts and records in such form and in such manner as may be prescribed.
  • The Corporation shall prepare or cause to be prepared annual balance sheet showing the profit and loss account, as may be prescribed.
  • The accounts of the Corporation shall be audited at least once in every financial year by such firm of Chartered Accountants as may be approved by Government.
  • A statement of the audited accounts under sub-section
  • Shall be furnished to Government within four months after the end of very financial year.

Recovery of dues. 20.

All sums due to the Corporation from any person shall be recoverable as arrears of land revenue.

Rules. 21

Government may make rules for carrying out the purposes of this Act.

Regulations. 22.

  • Subject to the provisions of this Act and the rules, the Corporation may make regulations for carrying out the purposes of this Act.
  • In particular and without prejudice to the generality of the foregoing power, such regulations may provide-for-
  1. The meetings of the Corporation.
  2. Conduct of business in such meetings.
  3. Terms and conditions of officers. Advisers and staff of the Corporation other than the Managing Director.
  4. Constitution of Financial, technical and advisory committees.
